Description [Abstrak] : In 1998, the China government has signed the ICCPR (International Covenant on Civil and Political Right) arrange in which human rights issues relating to the right to life, but until 2012 the China governments still reluctant to ratification the ICCPR convention. That giving rise tothe reaction of the international people out cry because the China government many executions that caused China to be a country that accounts for the world’s biggest victim of the death penalty. There a reseveral factors that cause the China government still to maintain the death penalty sentence, of which there are internal and external factors. The internal factors are a history and culture of China, communism and China patterns of thought leaders, political and social stability in China. The external factor is a China consequence of external factors in ratifying the ICCPR.
