\nin 2014 has increased the wave of braindrainer migration during the period 2014 to
\n2016, which gave rise to criticism from several parties and became a political
\neconomy discussion in the United States. Donald Trump ran as a Candidate for
\nPresident of the United States in the 2016 election and promised a policy of
\nreforming the H-1B visa with a selective mechanism that was more pro-American
\nduring his term of office. By using qualitative analysis techniques and collecting
\nprimary and secondary data based on archives, documents and the internet through
\nmass media reporting, this research in the form of descriptive case study research
\nexplains the policies of President Donald Trump and his administration in
\nreforming the H-1B visa immigration policy in the categories of merit and skillsbased worker migration (braindrainer). This research focuses on looking at Donald
\nTrump’s H-1B reform policy during his term as President of the United States (2017-
\n2021) which is divided periodically.The result of the research showed that President
\nDonald Trump’s policy in reforming the H-1B visa through the “Buy American Hire
\nAmerican” executive order tends to be restrictive by creating procedural policies
\nand administrative memoranda policies which cause the denial rate for
\nbraindrainers’ acceptance and extension of work period petitions to increase
\nsignificantly. Many of these rules and policies are not in accordance with legally
\napplicable standard rules, so that many companies who feel disadvantaged by this
\npolicy file lawsuits against the government which results in the revocation of rules
\nand policies that are not in accordance with the initial standards regulated in law.
